These Terms of Use and Sale, together with any documents incorporated by reference, govern your access to and use of Bawarchi Biryanis websites, mobile applications, kiosks, online ordering platforms, loyalty and rewards features, and related services, including the purchase and sale of products and services, whether you access them as a guest or registered user.
By accessing or using the Services, creating an account, participating in the Bawarchi Rewards Program, clicking “Accept,” “Agree,” or “Place Order,” or otherwise indicating your agreement, you acknowledge that you have read, understood, and agree to be bound by these Terms.
Throughout these Terms, “Bawarchi Biryanis,” “we,” “us,” and “our” refer to Bawarchi Biryanis and its applicable affiliates, franchisees, service providers, or participating locations, as applicable. “You” and “your” refer to the user, customer, guest, member, account holder, or other person accessing or using the Services.
Bawarchi Biryanis may update these Terms from time to time. Your continued use of the Services after changes are posted constitutes your acceptance of the updated Terms.
These Terms contain important provisions regarding dispute resolution, binding arbitration, waiver of jury trial, and waiver of class actions. Please review them carefully.

2. Communications with Bawarchi Biryanis
Certain areas of the Services may allow you to contact us, sign up for email notifications, text messages, newsletters, promotions, rewards updates, contests, customer support, or other communications. When you voluntarily sign up for these services and communications, you understand and consent to receiving marketing, transactional, operational, and informational messages from Bawarchi Biryanis, subject to applicable law and your communication preferences.
These areas are designed to allow users to contact us with questions or concerns, engage with us, or use features we may provide from time to time. They are not intended for unsolicited business ideas, proposals, concepts, techniques, procedures, methods, systems, designs, plans, charts, or similar materials.
If you submit any ideas, feedback, suggestions, menu ideas, service suggestions, or other materials to us, you acknowledge that such submissions will not be treated as confidential or proprietary. You agree that Bawarchi Biryanis may use such submissions without compensation or obligation to you, subject to applicable law.

3. User Accounts
Before you can use certain services associated with the Services, you may be required to register and create an account. You agree that all information you provide to us, including contact information, registration information, payment information, and loyalty account information, will be truthful, accurate, current, and complete.
You are responsible for maintaining the accuracy of your account information and for promptly updating any changes, including changes to your email address, phone number, payment method, or other account details.
You are responsible for maintaining the confidentiality of your account credentials. You agree to accept responsibility for all activities that occur under your account. You may not sell, trade, transfer, share, or otherwise provide access to your account to another person, except as expressly permitted by these Terms.
You agree to immediately notify us of any unauthorized use of your account or any other security breach. We are not responsible for any loss or injury that may result from unauthorized use of your account, whether or not you had knowledge of such use. You may be liable for losses incurred by Bawarchi Biryanis or others due to unauthorized use of your account.
By creating an account, you consent to receive communications from us electronically through the email address, phone number, app notification settings, or other contact information associated with your account. You may opt out of promotional communications where permitted, but we may continue sending transactional, account-related, security-related, order-related, or administrative messages as permitted by law.

4. Age Requirement
The Services are intended for users who are at least eighteen (18) years old. Users under eighteen (18) may use the Services or participate in the Program only with the consent and supervision of a parent or legal guardian.
If you are a parent or legal guardian, you agree that you have provided legal consent for the minor’s use of the Services, will monitor and supervise such use, and will be responsible for the minor’s activity on the Services.

5. Intellectual Property
The Services and their contents, features, and functionality, including but not limited to information, software, text, displays, images, photographs, video, audio, design, selection, arrangement, logos, company names, product names, service names, slogans, HTML code, and other materials, are owned by Bawarchi Biryanis, its affiliates, licensors, franchisees, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, transmit, sell, license, rent, reverse engineer, decompile, disassemble, or otherwise exploit any part of the Services or Bawarchi Biryanis content, except as expressly permitted by these Terms.
You must not:
Modify copies of any Bawarchi Biryanis content from the Services.
Use any photographs, videos, graphics, or other media separately from the accompanying text or outside the intended Services.
Delete or alter any copyright, trademark, or proprietary rights notices.
Impersonate Bawarchi Biryanis, a Bawarchi Biryanis employee, another user, or any other person or entity.
Use the Services or Bawarchi Biryanis content for any unauthorized commercial purpose.
Attempt to derive source code or create derivative works from the Services.
Any attempt to engage in prohibited activities is a violation of Bawarchi Biryanis’ intellectual property and proprietary rights and the rights of its licensors or service providers.

6. License to Use the Services
Bawarchi Biryanis grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use, regardless of whether the Services are accessed through a web browser, mobile browser, kiosk, mobile application, or other approved channel.
This license is subject to the following conditions:
You will use the Services only for lawful personal purposes.
You will not copy, distribute, modify, or exploit any part of the Services without prior written authorization from Bawarchi Biryanis.
You will not interfere with or disrupt the operation of the Services.
You will comply with all applicable laws and these Terms.
Bawarchi Biryanis may terminate or restrict your access to the Services at any time, for any reason or no reason, with or without notice, subject to applicable law. Following termination, these Terms will continue to apply to the extent necessary.

7. Prohibited Uses
You agree not to use the Services:
For any unlawful, fraudulent, abusive, harmful, or unauthorized purpose.
To violate any applicable local, state, federal, or international law.
To impersonate any person or entity.
To collect or harvest personal information from other users.
To transmit viruses, malware, corrupted files, or harmful code.
To interfere with the security or operation of the Services.
To use automated systems, including robots, spiders, scrapers, offline readers, or similar tools, in a manner that sends more requests to Bawarchi Biryanis servers than a person could reasonably produce using a standard web browser.
To solicit other users for commercial purposes.
To misuse coupons, rewards, points, promotions, or other Program benefits.
Bawarchi Biryanis grants public search engines limited permission to use spiders to copy materials from the Services solely for the purpose of creating publicly available searchable indices of the materials, but not caches or archives of such materials. Bawarchi Biryanis may revoke this permission at any time.

8. User-Submitted Content
The Services may allow you to submit reviews, feedback, text, images, photos, files, customer support messages, order-related information, loyalty-related information, or other materials and content, collectively referred to as “Submitted Content.”
By submitting Submitted Content, you represent and warrant that you own or have the necessary rights to submit such content and that your submission does not violate the privacy rights, publicity rights, copyrights, trademark rights, contract rights, or other rights of any person or entity.
You grant Bawarchi Biryanis a limited, non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, display, distribute, modify, store, host, and process Submitted Content for purposes related to operating, improving, marketing, supporting, or protecting the Services, subject to applicable law and our Privacy Policy.
You may not submit content that is unlawful, harmful, defamatory, obscene, abusive, threatening, harassing, hateful, discriminatory, violent, pornographic, invasive of privacy, infringing, fraudulent, misleading, or otherwise inappropriate. You may not submit content that contains viruses, corrupted files, harmful code, unauthorized advertising, business solicitation, or confidential information that you are not authorized to disclose.
Bawarchi Biryanis has no obligation to monitor Submitted Content, but reserves the right to review, remove, reject, edit, or restrict access to Submitted Content at any time, in its sole discretion, subject to applicable law.

9. Payment Methods
Bawarchi Biryanis may allow you to make card-based purchases through the Services by using a debit card, credit card, prepaid card, or other accepted payment method. Your user account is not a bank account. Bawarchi Biryanis is not a bank and does not offer banking, money transmission, or money service business services.
By adding or using a payment method, you represent and warrant that you are authorized to use that payment method. You are responsible for ensuring that your payment method is current, valid, non-expired, and accepted for payment.
Bawarchi Biryanis may temporarily authorize a small charge on your payment method as part of a verification process. You will not be required to pay this temporary authorization charge, and it should disappear from your statement in accordance with your payment provider’s policies.

10. Payment Authorization
By placing an order or linking a payment method to your account, you authorize Bawarchi Biryanis, participating locations, and their payment processors to charge your payment method for the full transaction amount, including applicable taxes, fees, delivery charges, service fees, tips, and any other amounts shown at checkout, less any valid rewards, discounts, or credits applied to your order.
If a charge is rejected or fails, Bawarchi Biryanis or its payment processor may attempt to process the charge again at a later time, subject to applicable law.
You represent and warrant that:
The payment information you provide is true, correct, and complete.
You are authorized to use the payment method.
Charges incurred by you will be honored by the issuing financial institution.
You will pay all charges incurred by you at the prices shown at checkout, including applicable taxes, fees, and charges.
All purchases and charges are also subject to the terms and conditions of the entities that issue your payment method and the applicable payment processor. You are responsible for complying with those terms.
Bawarchi Biryanis reserves the right to impose limits on transactions, reject transactions, or refuse payment methods at its discretion, subject to applicable law.

11. Payment Processing
Bawarchi Biryanis may use third-party payment processors to process payments made through the Services. Payment processing is subject to the terms, conditions, and privacy policies of the applicable payment processor, in addition to these Terms.
Bawarchi Biryanis is not responsible for errors, unauthorized charges, payment failures, delays, processing issues, or security issues caused by third-party payment processors, card issuers, banks, payment networks, or other third parties, except to the extent required by applicable law.

12. Orders Placed Through the Website or App
The Services may allow users to place online orders from participating Bawarchi Biryanis restaurants. When you place an order through the Services, you are ordering directly from the participating restaurant that accepts your order. The participating restaurant is responsible for preparing, packaging, and providing the products to you.
Your order is an offer to purchase the products and services listed in your order. All orders are subject to acceptance by the selected participating restaurant. Bawarchi Biryanis or the participating restaurant may decline, cancel, or refuse an order in its discretion, subject to applicable law.
Once your order is submitted, changes or cancellations may not be available unless the Services provide an edit or cancellation option or the participating restaurant agrees to the change.
Orders must be collected from the restaurant selected at the time of order submission. Pickup timing, holding time, food quality after delay, and cancellation policies may vary by location.

13. Prices, Taxes, Fees, and Availability
Prices will be displayed during the order process. The price charged for a product or service will be the price shown at the time the order is placed, subject to correction of errors, taxes, fees, and charges.
Posted prices may not include taxes, service fees, delivery fees, handling charges, or tips. Such amounts may be added to your order total and shown during checkout, in your order confirmation, or in your receipt.
Prices listed through the Services may differ from prices offered at individual franchise locations, in-store menus, third-party delivery platforms, or other sales channels. Prices, discounts, promotions, menu items, ingredients, product descriptions, calorie information, availability, and business hours may change without notice.
Bawarchi Biryanis strives to provide accurate information, but may occasionally make typographical errors, pricing errors, availability errors, menu errors, or other inaccuracies. Bawarchi Biryanis reserves the right to correct errors, inaccuracies, or omissions at any time and to cancel orders resulting from such errors, subject to applicable law.
The inclusion of any product or service on the Services does not guarantee that the product or service will be available at the restaurant where you place or collect your order.
Promotions may be governed by separate terms and conditions. If there is a conflict between promotion-specific terms and these Terms, the promotion-specific terms will control for that promotion.

14. Delivery Orders
In some locations, the Services may allow you to place an order for delivery. Delivery may not be available at all locations, at all times, or for all menu items.
Delivery requests may be fulfilled by a participating restaurant, third-party delivery vendor, or other service provider in Bawarchi Biryanis’ discretion. Delivery times are estimates only and are not guaranteed.
Bawarchi Biryanis, participating restaurants, and delivery vendors reserve the right to accept, decline, cancel, or modify delivery orders for any reason, including address availability, driver availability, item availability, weather, operational issues, safety concerns, or suspected misuse.
You agree that Bawarchi Biryanis may provide your contact information, including your name, phone number, address, and order details, to delivery vendors or service providers as necessary to fulfill your order.
Prices shown on third-party delivery platforms may differ from prices offered in-store, on the Bawarchi website, or through the Bawarchi mobile app.

15. Returns and Refunds
Bawarchi Biryanis does not accept returns of food, beverages, goods, or services purchased through the Services.
Refunds may be issued at the discretion of Bawarchi Biryanis, the participating restaurant, or its agents, based on the circumstances of each request and subject to applicable law. Approved refunds will generally be processed to the original payment method used for the order.
Refund processing times may vary based on the payment processor, payment method issuer, bank, or other financial institution.

16. Failed Transactions
If Bawarchi Biryanis or its payment processor is unable to successfully charge your payment method, your order may not be completed, or your account may reflect an outstanding balance.
You agree to promptly resolve any outstanding unpaid balance by providing a valid payment method or making payment through another approved method. Bawarchi Biryanis is not responsible for fees, charges, penalties, or declined transaction fees imposed by your card issuer, bank, or payment provider.
If an outstanding balance remains unpaid, Bawarchi Biryanis may take reasonable steps to collect the amount owed, subject to applicable law.

17. Prohibited Transactions
The Services may only be used for bona fide purchases of goods or services offered by participating Bawarchi Biryanis locations in the ordinary course of business.
The Services may not be used to transfer money between parties, request cash back, provide cash advances, process loans, cash checks, distribute cash, conduct gambling activity, or engage in any fraudulent, unauthorized, or prohibited transaction.
Bawarchi Biryanis reserves the right to decline any transaction that appears to violate these Terms or applicable law.

18. Receipts and Statements
Bawarchi Biryanis may provide electronic transaction receipts through email, text message, app notification, in-Service notification, or other available communication channels, based on your account settings and communication preferences.
Charges to your authorized payment method may appear on your card or bank statement with the Bawarchi Biryanis name, location identifier, store name, payment processor name, or other related descriptor.
You agree not to knowingly or falsely report valid charges as fraudulent or unauthorized. A knowingly false report may result in termination or suspension of your account, cancellation of rewards, restriction from future use of the Services, and any other remedies available to Bawarchi Biryanis.

19. Mobile Services and Text Messaging
If you use the Services on a mobile device, you are responsible for obtaining and maintaining your device, wireless service, data service, internet access, and related charges.
You may have the option to receive text messages from or on behalf of Bawarchi Biryanis, including marketing, loyalty, promotional, transactional, operational, and informational messages. By providing your mobile number and opting in where required, you consent to receive such messages, including messages sent using automated technology, subject to applicable law.
Message and data rates may apply. Message frequency may vary.
You may receive text alerts from 1-833-975-3598. To opt out of promotional text messages, reply STOP. For help, reply HELP or contact support@bawarchibiryanis.us.
Even if you opt out of promotional text messages, Bawarchi Biryanis may still send transactional, operational, order-related, account-related, or legally permitted messages where allowed by law.
Many Bawarchi Biryanis restaurants are independently owned and operated by franchisees. These Terms may not apply to separate text messaging programs operated by individual franchisees or third parties. If you receive text messages from a franchisee or third-party platform, you may need to opt out directly through that program.
By providing your mobile number, you represent that you are the current subscriber or authorized user of that number. You agree to promptly notify us if your mobile number changes or is no longer associated with you.

20. Third-Party Links
The Services may contain links to third-party websites, platforms, applications, or services that are not owned, operated, maintained, or controlled by Bawarchi Biryanis.
Third-party links are provided for convenience only. Bawarchi Biryanis does not endorse, control, or assume responsibility for third-party content, policies, products, services, websites, or practices. Accessing third-party links is at your own risk.

21. Service Updates
Bawarchi Biryanis may make available updates, upgrades, patches, modifications, or enhancements to the Services. These updates may be required for continued use of the Services and may be installed automatically where permitted by your device settings and applicable law.
You agree to accept Service updates and are responsible for any costs associated with receiving them, including data or internet charges.

22. Apple App Terms
If you download or use the Services through an iPhone, iPad, or other Apple device, you acknowledge that these Terms are entered into between you and Bawarchi Biryanis, not Apple Inc.
Apple has no obligation to provide maintenance or support for the Services. Any claims related to the possession or use of the Apple application are between you and Bawarchi Biryanis, not Apple. Apple is not responsible for claims that the Apple application infringes third-party intellectual property rights.
These Terms incorporate and supplement applicable Apple App Store terms to the extent required.

23. Disclaimer of Warranties
The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Bawarchi Biryanis disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, reliability, security, and uninterrupted operation.
Bawarchi Biryanis does not warrant that the Services, content, information, menu details, pricing, rewards, offers, order functionality, payment functionality, delivery functionality, or other features will be accurate, complete, secure, reliable, uninterrupted, error-free, or available at all times.
Bawarchi Biryanis does not warrant that defects will be corrected, that the Services will be free of viruses or harmful components, or that the Services will meet your requirements or expectations.
You acknowledge that your use of the Services is at your own risk.

24. Limitation of Liability
To the fullest extent permitted by law, Bawarchi Biryanis and its parents, affiliates, subsidiaries, franchisees, officers, directors, employees, agents, representatives, contractors, vendors, licensors, and service providers shall not be liable for any indirect, incidental, special, punitive, consequential, exemplary, or similar damages, including lost profits, lost data, business interruption, loss of goodwill, cost of substitute goods or services, computer failure, system failure, or other damages arising out of or related to your use of or inability to use the Services.
To the fullest extent permitted by law, Bawarchi Biryanis’ total liability for all claims arising out of or related to the Services or these Terms shall not exceed the greater of the amount you paid to Bawarchi Biryanis through the Services during the six (6) months before the event giving rise to the claim or ten dollars (US $10.00).
Some jurisdictions do not allow certain limitations or exclusions of liability. In such jurisdictions, the limitations will apply to the fullest extent permitted by law.

25. Time Limitation for Claims
To the fullest extent permitted by law, any claim, action, or proceeding arising out of or related to the Services or these Terms must be filed within one (1) year after the cause of action arose, or it will be permanently barred.

26. Indemnification
You agree to defend, indemnify, and hold harmless Bawarchi Biryanis, its parents, affiliates, subsidiaries, franchisees, officers, directors, employees, agents, representatives, contractors, vendors, licensors, and service providers from and against any claims, demands, causes of action, liabilities, damages, judgments, awards, losses, costs, expenses, or fees, including reasonable attorneys’ fees, arising out of or related to:
Your violation of these Terms.
Your violation of any applicable law, rule, or regulation.
Your use or misuse of the Services.
Your Submitted Content.
Any information or material submitted through your device, computer, account, or payment method.
Any misrepresentation made by you.
Any dispute between you and another user related to the Services.
The theft, misappropriation, or unauthorized disclosure of your account credentials.
Your authorization of another person to use your account.
Your use of any products or services provided through the Services.
Bawarchi Biryanis reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification. You agree not to settle any matter without Bawarchi Biryanis’ prior written consent.

27. Dispute Resolution, Arbitration, and Class Action Waiver

Informal Dispute Resolution
Before either party initiates arbitration or files a claim, the party asserting the dispute must first try in good faith to resolve the dispute by providing written notice to the other party. The notice must describe the facts and circumstances of the dispute and provide any relevant documentation.

The receiving party will have thirty (30) days to respond or attempt to resolve the dispute.

Binding Individual Arbitration
If the dispute cannot be resolved through informal dispute resolution, any claim, dispute, or controversy arising out of or related to these Terms, the Services, your purchase of products or services, or your participation in the Rewards Program shall be resolved by binding individual arbitration, except where prohibited by law or where a qualifying claim may be brought in small claims court.
The arbitration shall be administered by the American Arbitration Association under its applicable Consumer Arbitration Rules, unless the parties agree otherwise or another arbitration provider is required.
The arbitrator shall have authority to resolve disputes regarding the interpretation, applicability, enforceability, or formation of this arbitration agreement, including any claim that all or part of the arbitration agreement is void or voidable.
The arbitrator may award any relief available in court on an individual basis. The arbitration award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Small Claims Court
Either party may bring an individual claim in small claims court if the claim qualifies and remains on an individual, non-class, non-representative basis.

Jury Trial Waiver
You and Bawarchi Biryanis agree to waive the right to a jury trial to the fullest extent permitted by law.

Class Action Waiver
You and Bawarchi Biryanis agree that each may bring claims against the other only in an individual capacity and not as a plaintiff, class member, representative, or participant in any class, collective, consolidated, private attorney general, or representative action.
If any part of this class action waiver is found unenforceable as to a particular claim, that claim must proceed in court and be severed from any arbitration proceeding, unless otherwise required by law.

28. Governing Law and Jurisdiction
These Terms and any dispute arising out of or related to these Terms, the Website, the App, the Services, or the Rewards Program shall be governed by the laws of the State of Texas, without regard to conflict of law principles.
Subject to the arbitration provisions above, any legal suit, action, or proceeding arising out of or related to these Terms or the Services shall be instituted in the federal or state courts located in Texas, unless applicable law requires otherwise.

29. Notices
We may provide notice to you by sending a message to the email address or phone number associated with your account, posting notice through the Services, or using another legally permitted method. Notices sent by email are effective when sent. Notices posted through the Services are effective upon posting.

30. Waiver and Severability
No waiver by Bawarchi Biryanis of any term or condition in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition.
If any provision of these Terms is held invalid, illegal, or unenforceable by a court or other tribunal of competent jurisdiction, the provision shall be eliminated or limited to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

31. Assignment
Bawarchi Biryanis may assign these Terms, including its rights and obligations, to any person or entity, including in connection with a merger, acquisition, sale of assets, restructuring, or operation of law.
You may not assign these Terms, in whole or in part, without prior written consent from Bawarchi Biryanis. Any attempted assignment that does not comply with these Terms will be null and void.

32. Survival
Any provisions of these Terms that by their nature should survive termination shall survive, including provisions related to intellectual property, payment obligations, disclaimers, limitation of liability, indemnification, dispute resolution, governing law, and any other provisions that reasonably should survive.

33. Entire Agreement
These Terms, the Privacy Policy, and any applicable Program Rules, offer terms, or additional terms incorporated by reference constitute the entire agreement between you and Bawarchi Biryanis with respect to the Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, whether written or oral, relating to the Services.

BAWARCHI BIRYANIS REWARDS CLUB OR LOYALTY PROGRAM TERMS AND CONDITIONS

1. Program Overview
The Bawarchi Biryanis loyalty program may be referred to as “Bawarchi Rewards Club,” “Bawarchi Rewards,” or “Bawarchi Club.” All such names refer to the same loyalty program.
The Program is offered by Bawarchi Biryanis and may be available at participating Bawarchi Biryanis locations in the United States. Program availability, rewards, offers, earning rates, redemption options, and benefits may vary by location, order channel, system setup, and applicable offer terms.
All Program benefits, offers, rewards, points, coupons, and services are subject to availability. Bawarchi Biryanis may amend, modify, supplement, suspend, or terminate the Program, these Program Rules, the structure for earning points, reward redemption levels, benefits, offers, or eligibility requirements at any time, subject to applicable law.
If the Program is terminated, all unredeemed points, rewards, offers, and benefits may be forfeited without obligation or liability, unless otherwise required by law.

2. Eligibility and Membership
Membership is free and optional. No purchase is required to join the Program.
Membership is open to natural persons only. Corporations, groups, associations, and other entities are not eligible to participate.
The Program is available only in the United States at participating Bawarchi Biryanis locations and approved digital channels.
You may enroll in the Program by providing the required information through approved channels, which may include participating store locations, the Bawarchi Biryanis website, or the Bawarchi mobile application.
Bawarchi Biryanis may decline, suspend, or cancel membership in the Program at its discretion, subject to applicable law.
Program benefits and rewards are currently non-transferable. Upon the death of a member, the member’s loyalty account may be closed and any unused points, rewards, or benefits may be forfeited, unless otherwise required by law.
When enrolling as a general member, you will enter the Program as a STAR Member.

3. Privacy and Program Communications
Personal information provided in connection with the Program will be handled in accordance with the Bawarchi Biryanis Privacy Policy.
Because we use your mobile number and email address to identify you as a member and notify you of Program benefits, rewards, account updates, and transaction activity, you must keep your mobile number and email address accurate and current.
When you enroll in the Program and provide your email address or phone number, you may receive Program-related communications, transactional messages, reward updates, point balance updates, expiration reminders, order-related messages, and promotional messages, subject to your opt-in preferences and applicable law.
You may opt out of promotional emails by using the unsubscribe link in the applicable email. You may opt out of promotional text messages by replying STOP. Even if you opt out of promotional communications, you may still receive transactional, account-related, order-related, or legally permitted messages.

4. Membership Status Levels

STAR Member
STAR status is free to join and does not require any minimum annual qualifying spend.
STAR Members may earn 10 points for every $1 spent on eligible purchases, subject to the Program terms, exclusions, and applicable store participation rules.

VIP Member
VIP status may be available to Members who meet the applicable annual qualifying spend requirement of $1,000 per membership year.
To maintain VIP status, Members may be required to continue meeting the applicable annual qualifying spend requirement during each membership year.
VIP Members may earn 11 points for every $1 spent on eligible purchases and may receive additional benefits, including a welcome bonus, birthday offer, and special pricing, where available and subject to applicable terms.

VVIP Member
VVIP status may be available to Members who meet the applicable annual qualifying spend requirement of $3,000 per membership year.
To maintain VVIP status, Members may be required to continue meeting the applicable annual qualifying spend requirement during each membership year.
VVIP Members may earn 12 points for every $1 spent on eligible purchases and may receive additional benefits, including a welcome bonus, birthday offer, and special pricing, where available and subject to applicable terms.

Modification of Membership Requirements and Benefits
Bawarchi Biryanis reserves the right to modify, update, suspend, or discontinue membership requirements, tier benefits, earning rates, eligibility criteria, qualifying spend requirements, or status criteria at any time, subject to applicable law.
Any benefits, offers, earning rates, or tier privileges are subject to availability, participating locations, applicable exclusions, and the terms of the specific offer.

5. Qualifying Purchases
A “Qualifying Purchase” means an eligible purchase of products from participating Bawarchi Biryanis locations for personal use, excluding taxes, tips, service fees, delivery fees, handling charges, discounts, coupons, rewards redemptions, gift cards, gift certificates, store credits, refunds, third-party marketplace orders, catering orders, party trays, alcohol, and any other excluded items unless expressly stated in the applicable offer or Program terms.
You will not earn points on the value of any coupon, discount, reward, credit, or other benefit applied to your purchase.
Bawarchi Biryanis may determine, modify, or clarify what qualifies as a Qualifying Purchase at any time, subject to applicable law.

6. Earning Points
Members may earn points on eligible Qualifying Purchases made at participating Bawarchi Biryanis locations.
To earn points for website or mobile app orders, members must be signed into their Bawarchi Rewards account at the time of purchase. Points will be added only for eligible purchases made through the member’s registered account.
To earn points for eligible dine-in or in-store purchases, members may be required to provide their registered phone number at checkout or submit a missing points claim through the website or mobile app, where available.
All points earned will accumulate in one Program account associated with the member’s registered mobile number, email address, or account profile.
There is no limit on the number of points you may earn unless otherwise stated in a specific offer, promotion, or Program rule.
Points have no cash value and may not be redeemed for cash.
If points are issued for a purchase that is later refunded, canceled, reversed, adjusted, disputed, or determined to be ineligible, Bawarchi Biryanis may deduct, reverse, or adjust those points. If a deduction results in a negative points balance, the member may be required to earn additional points before becoming eligible for future redemptions.

7. Points Earning Rates
STAR Members earn 10 points for every $1 spent on eligible Qualifying Purchases.
VIP Members earn 11 points for every $1 spent on eligible Qualifying Purchases.
VVIP Members earn 12 points for every $1 spent on eligible Qualifying Purchases.
Bawarchi Biryanis may modify points earning rates at any time, subject to applicable law.

8. Bonus Points
From time to time, Bawarchi Biryanis may offer members the opportunity to earn bonus points through special promotions, campaigns, limited-time offers, app-based offers, website offers, in-store offers, or other Program-related activities.
Promotional materials may identify additional qualifying events, eligible products, excluded items, minimum purchase requirements, expiration dates, usage limits, participating locations, and other restrictions.
Bonus points earned through eligible promotions will count toward membership status qualification (VIP and VVIP) unless otherwise stated in the applicable offer.
Bawarchi Biryanis may modify, suspend, cancel, limit, or revoke any bonus points offer at any time, subject to applicable law.

9. Points Expiration Policy
The points expiration policy was activated in March 2026.

Bawarchi Biryanis may apply expiration rules to points earned through the Program. The expiration policy is intended to support fair customer redemption while helping maintain accurate and active loyalty account balances.

Points may expire as follows:

Points Earned in 2024
Points earned during calendar year 2024 may expire on May 31, 2026, or on another date communicated by Bawarchi Biryanis.
Any 2024 points not redeemed within the applicable redemption period may be forfeited and removed from the Member’s account, subject to applicable law.

Points Earned in 2025
Points earned during calendar year 2025, including points accumulated through January and February 2026 before the points expiration policy is activated, may expire on September 30, 2026, or on another date communicated by Bawarchi Biryanis.
Any such points not redeemed within the applicable redemption period may be forfeited and removed from the Member’s account, subject to applicable law.

Points Earned After Expiration Policy Activation
Points earned after the activation of the points expiration policy may expire three hundred sixty-five (365) days from the date the points are earned, unless otherwise communicated by Bawarchi Biryanis.
Any points not redeemed before the applicable expiration date may be forfeited and removed from the Member’s account, subject to applicable law.

Bawarchi Biryanis may send point expiration reminders through email, SMS, push notification, in-app message, or other available communication channels. Members are responsible for keeping their contact information accurate and current.
Failure to receive a reminder due to incorrect contact information, opt-out status, technical issues, delivery failure, or any other reason does not prevent points from expiring under the applicable expiration policy.
Expired points have no cash value and cannot be reinstated, transferred, exchanged, or redeemed unless Bawarchi Biryanis determines otherwise in its sole discretion.
Bawarchi Biryanis reserves the right to modify, pause, extend, correct, or apply the points expiration policy at any time, subject to applicable law.

10. Redeeming Rewards
Points may be redeemed for eligible complimentary Bawarchi Biryanis items at participating Bawarchi Biryanis locations in the United States.
Rewards, eligible items, minimum purchase requirements, redemption tiers, order channels, and participating locations may vary. Bawarchi Biryanis may change, remove, replace, or limit any reward or redemption tier at any time, subject to applicable law.
Current redemption options may include:
300 Points: Free dessert with a minimum qualifying purchase of $10.
500 Points: Free soup with a minimum qualifying purchase of $15.
1,000 Points: Free veg or chicken appetizer with a minimum qualifying purchase of $20.
1,500 Points: Free regular veg, egg, or chicken biryani with a minimum qualifying purchase of $30.
Rewards have no cash value and cannot be redeemed for cash, gift cards, alcohol, catering orders, party trays, taxes, tips, service fees, delivery fees, or other excluded items unless expressly stated in the applicable offer.
Only one reward redemption may be permitted per order unless otherwise stated.


11. Rewards Availability by Location
Not all Bawarchi Biryanis locations may support reward redemption, dine-in redemption, in-store redemption, all redemption tiers, all reward items, or all Program benefits.
Items available for redemption in each tier may vary by participating location, order channel, inventory, system setup, and the specific terms of each reward.
Bawarchi Biryanis may modify, limit, suspend, or discontinue reward availability at any time, subject to applicable law.


12. Dine-In, In-Store Rewards, and Missing Points Claims
Bawarchi Rewards benefits, including point earning, coupon redemption, and reward redemption, may be available for dine-in, in-store, website, and mobile app purchases at participating Bawarchi Biryanis locations.

Availability may vary by location, order channel, system setup, staff validation process, and the specific terms of each offer, coupon, or reward.
Not all Bawarchi Biryanis locations may support dine-in or in-store point earning, missing points claims, coupon use, or reward redemption at all times.
Certain rewards, coupons, signup offers, welcome offers, birthday offers, anniversary offers, promotional benefits, or other Program benefits may be valid only through the Bawarchi website, mobile app, or other approved digital ordering channels unless specifically stated in the applicable offer.

To earn points for website or mobile app orders, members must be signed into their Bawarchi Rewards account at the time of purchase. Points will be added only for eligible Qualifying Purchases made through the member’s registered account.
Some participating Bawarchi Biryanis locations may allow members to earn points, claim missing points, or redeem rewards for dine-in or in-store purchases at the location’s discretion. These benefits are not automatically available at all locations.

If a member believes they are eligible to earn points or redeem a reward for a dine-in or in-store purchase, the member may check with the participating location or submit a missing points claim through the Bawarchi website or mobile app using valid receipt details.
Members may be required to provide the store location, Clover ID, Toast bill number, receipt number, purchase date, bill amount, and any other transaction details required for verification.
Missing points claims, dine-in reward redemption, and in-store coupon use are subject to review and approval. Bawarchi Biryanis and participating locations may approve, reject, reverse, deduct, or adjust points, coupons, rewards, or benefits if:
The transaction cannot be verified.
The purchase is not eligible.
The location does not support dine-in or in-store redemption.
The offer terms are not met.
The receipt details are incomplete or incorrect.
The points were already issued.
The claim appears duplicate, fraudulent, abusive, or inconsistent with these Program Rules.

Members who do not receive points for an eligible dine-in or in-store transaction may submit a missing points request through the following channels:
Website: Sign In > My Account > My Rewards > Missing Points > Claim Now
App: Sign In > Rewards > Missing Points

13. Required Details for Missing Points Claims
To submit a missing points request, members may be required to provide the following details:
Store Location: The Bawarchi Biryanis location where the purchase was made.
Clover ID / Toast Bill Number: The Clover ID, Toast bill number, receipt number, or transaction reference shown on the receipt.
Purchase Date: The date of the transaction.
Bill Amount: The eligible purchase amount shown on the receipt.
Additional Receipt Details: Any other receipt or transaction details required for verification.
Bawarchi Biryanis may request additional information or documentation to verify a claim.

14. Excluded Purchases and Charges
Points will not be issued for third-party marketplace orders, catering orders, party trays, alcohol, taxes, tips, service fees, delivery fees, handling charges, gift cards, rewards redemptions, discounts, coupons, or any other excluded items unless expressly stated in the applicable offer or Program terms.

15. Other Important Redemption Information and Exclusions
Points may be redeemed only at participating Bawarchi Biryanis locations and only for eligible items.
Points are not eligible to be redeemed for alcoholic beverages, multi-serve food or beverage items, trays, platters, catering, third-party marketplace orders, taxes, tips, service fees, delivery fees, gift cards, cash, or other excluded items unless expressly stated in the applicable offer.
Members may not redeem multiple reward tiers in a single order unless otherwise stated. For example, a member may not redeem one reward for a free appetizer and another reward for a free soup in the same order unless the offer terms allow it.
Bawarchi Biryanis may limit redemption quantity, redemption frequency, eligible items, eligible locations, and eligible order channels at any time, subject to applicable law.

16. Additional Member Benefits
Bawarchi Biryanis may offer additional benefits to members based on membership level. Benefits may vary by location, availability, order channel, member eligibility, and the specific terms of each offer.
STAR Members receive a signup bonus (one free Biryani with a minimum bill of $25) and a birthday discount of 15% off (valid during the birthday month with a minimum bill of $25). STAR Members earn 10 points for every $1 spent on eligible Qualifying Purchases.
VIP Members receive a $10 OFF welcome bonus (with a minimum bill of $50), a birthday discount of 20% off (valid during the birthday month with a minimum bill of $25), special prices, and surprise offers. VIP Members earn 11 points for every $1 spent on eligible Qualifying Purchases.
VVIP Members receive a $20 OFF welcome bonus (with a minimum bill of $50), a birthday discount of 25% off (valid during the birthday month with a minimum bill of $25), special prices, and surprise offers. VVIP Members earn 12 points for every $1 spent on eligible Qualifying Purchases.
All benefits are subject to the specific terms of the applicable offer, including minimum purchase requirements, expiration dates, eligible locations, eligible order channels, and redemption limits.

17. Personalized Offers and Coupons
Bawarchi Biryanis may provide personalized offers, coupons, discounts, rewards, or promotions by email, SMS, push notification, app notification, website, or other available communication channels.
Personalized offers may be based on purchase behavior, preferences, location, membership status, order activity, or other Program-related information, subject to the Privacy Policy and applicable law.
Special offers may require activation through the app, website, email, SMS, or another approved method. Offers may have restrictions, including expiration dates, minimum purchase requirements, eligible items, eligible locations, eligible order channels, time-limited redemption periods, and redemption limits.
Special offers are personal to the member and may not be shared, copied, sold, transferred, or redeemed by another person unless expressly stated.
Bawarchi Biryanis reserves the right to change, suspend, revoke, limit, or cancel personalized offers and coupons at its discretion, subject to applicable law.

18. Double Points Days
Bawarchi Biryanis may offer Double Points Days or similar promotions where members can earn additional points on eligible purchases.
Bawarchi Biryanis may notify eligible members of a designated Double Points Day through email, SMS, push notification, app notification, or another available channel. Members may be required to activate the offer before use.
Double Points Days may be personalized and may vary by member, location, order channel, date, time, or eligible product.
Bawarchi Biryanis may exclude certain products, services, fees, or purchases from eligibility and may modify or discontinue the benefit at any time, subject to applicable law.

19. Program Communications
The Program may send transactional emails, text messages, push notifications, or app alerts related to your membership, including welcome messages, account updates, point balance updates, status updates, reward issuance, missing points claim updates, expiration reminders, and other Program-related communications.
To stop receiving promotional emails, use the unsubscribe link in the applicable email. To stop receiving promotional text messages, reply STOP. To stop receiving push notifications, update your device or app notification settings.
Some transactional, account-related, order-related, or legally permitted messages may continue even if you opt out of promotional communications.

20. Cancellation of Membership
Members must maintain an active Program membership to earn and redeem points.
You may opt out of the Program at any time by contacting support@bawarchibiryanis.us or through any available account cancellation method provided through the Services.
If you opt out of the Program, you will no longer earn points or be able to redeem points, and you may forfeit unused and unexpired points, rewards, offers, and benefits. Deletion or forfeiture of points may be final and cannot be reversed.

21. Errors, Adjustments, and Account Corrections
Despite our efforts to ensure accuracy, errors may occur. Bawarchi Biryanis reserves the right to correct errors, inaccuracies, or omissions at any time, including errors related to points, rewards, coupons, offers, account balances, redemption eligibility, membership status, or Program benefits.
Bawarchi Biryanis may deduct, reverse, cancel, expire, adjust, or refuse points, rewards, coupons, offers, or benefits if they were issued, earned, or redeemed due to error, fraud, misuse, abuse, technical issue, system issue, staff error, configuration error, duplicate claim, ineligible purchase, or violation of these Program Rules.
In the event of any inconsistency between these Program Rules and statements in advertising, marketing materials, emails, SMS messages, app screens, staff statements, or other Program-related materials, the then-current Program Rules will control, unless otherwise required by law.

22. Fraud, Abuse, and Misuse
Bawarchi Biryanis may cancel, suspend, restrict, or terminate your Program participation or account if it suspects fraud, abuse, misuse, unauthorized activity, duplicate accounts, unauthorized transfer of benefits, manipulation of transactions, misuse of coupons, misuse of rewards, false missing points claims, chargebacks, false fraud reports, or violation of these Program Rules.
Bawarchi Biryanis may also reverse points, deduct points, cancel rewards, void coupons, reject redemptions, or restrict future participation where fraud, misuse, abuse, or error is identified.

23. Program Changes or Termination
Bawarchi Biryanis may amend, modify, supplement, suspend, or terminate the Program, Program Rules, benefits, offers, earning rates, redemption tiers, reward items, expiration rules, and eligibility requirements at any time, subject to applicable law.
Changes may affect the value of points, the ability to earn points, the ability to redeem rewards, membership status, or the availability of specific benefits.
If the Program is terminated, all unredeemed points, rewards, and benefits may be forfeited without compensation, unless otherwise required by law.
Bawarchi Biryanis will not be liable for any delay or failure in performance due to events beyond its reasonable control, including acts of nature, system failures, vendor issues, power failures, communications failures, labor issues, supply issues, government action, or other circumstances beyond reasonable control.

24. Severability
If any provision of these Program Rules or the application of any provision to any person or circumstance is held invalid, illegal, or unenforceable, the remaining provisions shall not be affected and will continue in full force and effect to the maximum extent permitted by law.

25. No Waiver
Bawarchi Biryanis’ failure to insist upon or enforce strict compliance with any provision of these Program Rules shall not be construed as a waiver of any provision or right.
No waiver shall prevent Bawarchi Biryanis from enforcing such right or provision in the future.

26. Limitation of Liability for the Program
Except as otherwise expressly provided, the Program and all related rewards, benefits, products, services, offers, and communications are provided on an “as is” and “as available” basis.
To the fullest extent permitted by law, Bawarchi Biryanis, its affiliates, franchisees, vendors, partners, and service providers disclaim all warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, availability, accuracy, reliability, and non-infringement.
The Program is not warranted to be uninterrupted, error-free, or available at all times.
To the fullest extent permitted by law, Bawarchi Biryanis’ aggregate liability for claims arising out of or related to the Program shall not exceed the lesser of the amount paid by you for participation in the Program during the prior twelve (12) months or ten dollars (US $10.00).

27. Release and Indemnification for Program Participation
By participating in the Program, you agree to release Bawarchi Biryanis, its affiliates, franchisees, divisions, officers, directors, employees, agents, vendors, and service providers from claims, damages, losses, liabilities, and expenses related to your membership, participation in the Program, use or attempted use of rewards, or these Program Rules, to the fullest extent permitted by law.
You agree to indemnify, defend, and hold harmless Bawarchi Biryanis, its affiliates, franchisees, shareholders, officers, directors, employees, agents, distributors, vendors, and service providers from and against any third-party claims, demands, liabilities, costs, or expenses, including reasonable attorneys’ fees, arising out of your breach of these Program Rules, misuse of the Program, fraud, false claim, or violation of applicable law.

28. Dispute Resolution and Arbitration
Disputes related to the Program are subject to the dispute resolution, arbitration, jury trial waiver, and class action waiver provisions contained in the Bawarchi Biryanis Terms of Use and Sale, which are incorporated into these Program Rules by reference.
These Program Rules and any dispute related to the Program shall be governed by the laws of the State of Texas, without regard to conflict of law principles.

29. Termination
These Program Rules remain effective unless and until terminated by either you or Bawarchi Biryanis.
You may terminate your Program membership at any time by canceling your membership through an available account method or by contacting support@bawarchibiryanis.us.
Bawarchi Biryanis may terminate, suspend, or restrict your Program membership at any time if Bawarchi Biryanis determines that you failed to comply with these Program Rules, misused the Program, engaged in fraud or abuse, or violated applicable law.
The obligations and liabilities incurred before termination will survive termination for all purposes.
